Terms & Conditions

Effective Date: January 01, 2026

1. Services Provided

The Plan includes:

  • Daily automated backups of your website
  • Monthly WordPress core, theme, and plugin updates
  • 24/7 uptime and security monitoring
  • Emergency recovery if your site goes down
  • Up to 30 minutes per month of minor fixes and support
  • Priority support and discounted hourly rates for additional work

We may modify services at any time, provided existing coverage is not reduced without notice.

2. Fees & Billing

  • Monthly Plan: $150 per site per month
  • Annual Plan: $1,350 per site per year
  • Additional sites: $100 per month (monthly) or $1,200 per year (annual)

Payments must be made in advance. Monthly plans can be canceled anytime; annual plans are non-refundable but cancellation prevents renewal.

4. Limitations of Service

  • Plan includes up to 30 minutes/month of minor fixes; extra work billed separately
  • Plan does not guarantee prevention of hacking, malware, or downtime
  • Updates are done carefully; issues will be resolved using backups if needed

5. Your Responsibilities

  • Provide accurate website access credentials
  • Ensure compliance with applicable laws
  • Notify us promptly of any website issues

6. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages, including:

  • Loss of revenue, leads, or business opportunities
  • Loss of data not covered by the Plan
  • Downtime or performance issues

Our liability for direct damages is limited to fees paid in the prior 12 months.

7. Indemnification

You agree to indemnify and hold harmless Roxy Cruz Web Design, its employees, and contractors from any claims, damages, or expenses arising from:

  • Your website content or activities
  • Misuse of services or failure to comply with these Terms

8. Termination

We may suspend or terminate services immediately if:

  • You violate these Terms
  • Payment is not received
  • Services are used for illegal or harmful purposes

Termination does not remove responsibility for outstanding payments.

9. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page. Continued use constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of the state of Texas. Any disputes shall be resolved in the courts of the state of Texas.
